LakeHomesUSA.com Agent Advertising Contract

It is understood that this contract is between Rainy Lake Enterprises, Inc, d/b/a Lakehomes USA (Company) and the party purchasing advertising on Company's Website (referred to as Agent).

ADVERTISING PACKAGE INCLUSIONS & LIMITATIONS

Agent understands that they are purchasing a specific advertising package from Company, allowing Agent to place an Agent Page or a link to Agent's website on Company Website. Agent also understands that along with this advertising package, they also have the right to place any property listings they choose on the Company Website, if that package permits, so long as they are the sole listing agent or a cooperating listing agent on that particular property. This contract does not cover other company listings or listings from other real estate agents. And although Company has the right to allow extraneous listings to be placed on Company Website as a means to create a more comprehensive database for the consumer, blatant attempts by Agents to add large numbers of listings that aren't their own may force removal of those listings for the good of the Website and its affiliate Agents.


PERSONAL PASSWORD & MISUSE OF PASSWORD

Agent understands that they will choose a personal password that will enable them to make changes accordingly on their particular listings. Agent agrees to keep this password confidential, and that any misuse of this password from an outside party to alter information on Agent's Page or listings, would be an indication that they have shared said password with another party. Company should be immediately notified of any misuse so that remedies can be made accordingly.

ENTRY OF INFORMATION ON WEBSITE

Agent understands it is their responsibility to enter all information and photos pertaining to said listings and agent pages. If Agent needs assistance entering photos, they should contact a party who has the ability and knowledge to scan photos or upload from a digital camera or other source.

EXTENT OF LISTING TIME PERIOD & RENEWALS

Agent understands that they are purchasing an Agent Page or Agent Link advertising package that will remain on Company Website for a period of one (1) year. Agent will be given an email renewal notice before the one (1) year time period ends so that they have ample time to renew before Agent Page, Agent Links, and all Agent listings are removed from Company Website.

REMOVAL OF LISTINGS & AGENT PAGE FROM WEBSITE

If agent does not renew before the one (1) year time period lapses, Agent Page, Agent Links, and all Agent listings will be removed from Company Website. If they choose to add an Agent Page or Agent Link again on Company Website once this removal has taken place, they will have to re-enter all information on Agent Page, Agent Links and listings once again, and any discounts for renewals will not be granted. No information will be saved for later use once the renewal period lapses.

PRICING & LIMITATION OF LISTINGS

Agent agrees to the prices set forth in the advertising package they have chosen, and understands that they will be charged one time in the method of payment they have selected. This advertising contract covers one (1) specific Agent and his or her listings. There are no contracts between real estate companies and Company, but only individual agents or brokers of those real estate companies. Company names and logos can and should be used, but an individual Agent or broker must be listed as the contact person. This holds true with a Broker who runs a one-person office.

LIMITATION ON PLACEMENT OF LISTINGS IN MARKET AREAS

Agent may place each property listing in no more that two (2) market areas of Website, so as to maintain relevancy and accuracy of Website to the greatest extent possible. Company understands the need for overlapping areas and therefore agrees that placing listings in two (2) market areas is appropriate, and many times beneficial, for the Agent, as well as the end user. However, areas must be adjoining as based on Website's Featured Areas, ans should always be relevant to the consumer. Any attempt to place listings in more than two (2) market areas or non-appropriate market areas, as stated, will be seen as an effort to bypass Website's terms and conditions and may result in termination of Agent's listings and Agent's Page from Website without refunds for any monies already paid by Agent for these services.

TIMELY REMOVAL OF LISTINGS

Agent agrees that he or she will remove properties no longer available for sale on a timely basis to keep Company website as accurate as possible. Advertiser also agrees to make any changes to contact information and property pricing accordingly, so that all information on Company Website is of a current nature.

RENEWAL PRICING

Agent understands that Company has the right to adjust prices on all Agent Pages and Advertising Packages at any time, but those changes will not affect contracts with Agent Pages and other Advertising Packages already in place. Although Company may at times offer discounts for renewals and other promotions, it is in no way to be construed as an overall pricing discount for every Agent and Advertiser on Company Website. Renewal prices will be determined at the time of renewal, and will not be affected by Agent's initial pricing for Agent Pages and/or Advertising Packages.

FEATURED LISTINGS

Agent also has the option to enter their property listings as Featured Listings for an additional fee, to give those listings widespread exposure on the main State Page that those properties are listed under. Please follow the link at FEATURED LISTINGS to find out more about this added benefit.
